AIRYBO Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the AIRYBO website, web application, and mobile applications (together, the "Service"), operated by B'tle LLC ("B'tle," "we," "us"), a limited liability company registered in New York. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

2. What AIRYBO is — and the ephemerality you are agreeing to

AIRYBO is an ephemeral, neutral reference layer. This is the Service's defining feature, and you must understand it before using AIRYBO:

  • Content on AIRYBO — shelves, items, references, notes, and captures — exists only for a bounded, visible period. Expiry timestamps are displayed in the product.
  • When content expires, it is irreversibly deleted from our active systems. There is no archive, no trash folder, no restore path, and no history. Neither you nor we can recover expired content.
  • Capacity is intentionally bounded. Each tier holds a fixed number of shelves and items; there are no overflow queues and no way to expand capacity by configuration.
  • AIRYBO is not a storage, backup, or archival service. Do not use AIRYBO as the only home of anything you cannot afford to lose. You are solely responsible for retaining your own copies of any content you need beyond its displayed lifetime.

We will never be liable for the deletion of content that expired according to the rules displayed in the product — deletion on expiry is the Service working as designed and as promised.

3. Accounts

You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account. You must be at least 13 years old (or older where local law requires) to create an account.

4. Tiers and access

The Service offers a free tier ("Access") and paid subscription tiers (currently "Pro"). Features and capacities of each tier are described on the AIRYBO website and may evolve. Paid tiers are purchased on the AIRYBO website only; the mobile applications unlock your tier when you sign in. Your tier is determined by our records, not by the client application.

5. Purchases, billing, and the merchant of record

Paid subscriptions are sold by the payment provider named at checkout, our merchant of record. When you purchase a subscription:

  • The transaction is between you and that provider. It processes payment, collects and remits applicable taxes, and issues your invoice.
  • Charges appear on your statement under its name.
  • Subscriptions renew automatically at the displayed interval until cancelled. You may cancel at any time from your account page, effective at the end of the current billing period; you retain full access until then, and your account then continues on the free Access tier (or you may delete your account entirely at any time).
  • Your first purchase of a subscription is covered by a 30-day money-back guarantee. Renewal charges are governed by our Refund Policy (in brief: monthly renewals are not refundable; annual renewals are refundable within 14 days of the renewal charge), administered through our payment provider.

Purchases are made from the payment provider named at checkout, our merchant of record, and are subject to that provider's buyer terms (linked at checkout).

6. Your content and licenses

You retain ownership of content you create on the Service. You grant B'tle LLC a limited, non-exclusive, worldwide license to host, process, display, and transmit your content solely to operate the Service — including publishing shelves you choose to publish, delivering them to recipients, and deleting them on expiry. This license ends when the content is deleted — which, on AIRYBO, is designed and engineered to happen automatically on expiry.

For creators publishing public shelves: you represent that you have the rights to share the references and materials you publish, and that your published content complies with Section 7. Affiliate or attribution links you include in your references are preserved as you provided them.

7. Acceptable use

You agree not to use the Service to:

  • violate any law or the rights of others, including intellectual-property rights;
  • distribute malware, spam, or deceptive content;
  • publish content that is illegal, infringing, or that exploits or endangers minors;
  • attempt to circumvent the Service's temporal, capacity, or access rules, probe or disrupt our infrastructure, or access another user's account or content without authorization;
  • scrape, harvest, or systematically extract content or data from the Service;
  • resell or provide the Service to third parties except as the product's sharing features intend.

We may remove content or suspend or terminate accounts that violate these Terms. Where practicable and lawful, we will tell you why.

8. Copyright complaints

If you believe content on the Service infringes your copyright, send a notice compliant with the DMCA to our designated agent: Copyright Agent, B'tle LLC, 108 W 39th St, Ste 1006, PMB 2493, New York, NY 10018, +1 917-687-4187, support@airybo.com. We will respond as the DMCA requires, including removing infringing content and terminating repeat infringers where appropriate.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for violation of these Terms, for legal compliance, or if we discontinue the Service. On account deletion or termination, your content is deleted under the same irreversible process that governs expiry; public shelves you aired are retired and then deleted as described in our Privacy Policy. Sections that by their nature survive termination (including Sections 2, 6 licensing tail, 10, 11, 12, and 13) survive.

10. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, B'tle LLC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any content will remain available for any period beyond its displayed expiry — and by design, it will not.

11. Limitation of liability

To the fullest extent permitted by law, B'tle LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill — including any claim arising from the expiry and irreversible deletion of content operating as designed. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the claim arose, or (b) fifty US dollars.

Nothing in these Terms limits any rights you have under mandatory consumer-protection law in the country where you live.

12. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts.

13. Force majeure

B'tle LLC will not be liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, power or telecommunications failures, hosting-provider outages, cyberattacks, acts of war or terrorism, labor disputes, or governmental action. For clarity: expiry-driven deletion is a designed function of the Service, not a failure of performance, and is not affected by this section.

14. Changes to these Terms

We may update these Terms. If a change is material, we will provide reasonable notice (for example, on the website or by email). Continued use of the Service after the effective date of a change constitutes acceptance.
